SimplyTrak Standard Warranty Agreement

Warranty to cover

• 1. This warranty is for the period of 12 months commencing on the date of installation of SimplyTrak Units.
• 2. The warranty is for a swap-out of any unit not performing as originally specified upon the initial agreement.
• 3. The warranty covers both parts and labour for any maintenance required to the units.
• 4. SimplyTrak do not track customers units. The warranty relies upon the customer to inform SimplyTrak of any problems with SimplyTrak hardware or software.

Limitations of warranty

• 1. This warranty is limited to the malfunctioning of units only due to faults with the unit and/or software.
• 2. It excludes any units not fitted by a SimplyTrak authorised representative.
• 3. It excludes any units that have been refitted in part or completely by anyone other than an authorised SimplyTrak representative.
• 4. It excludes units interfered with in any way following the fitting by an authorised representative.
• 5. It excludes units damaged in any way whether this is in the course of a vehicular accident or by deliberate means - to include damage of any type.
• 6. Calculation errors can occur caused by local environmental conditions and/or incomplete data.
• 7. Neither SimplyTrak or any of its authorised distributors shall in any way be liable to you and you hereby waive any direct, indirect, economic, special, commercial, incidental, exemplary or consequential damages (including without limitation) loss of profits, loss of business revenue or earnings, lost data, data call cost, telephone call cost, damages caused by delay or failure to realize expected savings arising from or in conjunction with the use or performance of the Software and/or Hardware, even if SimplyTrak or an authorised distributor are aware of the possibilities of such damage.
• 8. SimplyTrak nor any of it's authorised representatives or distributors shall be liable for any software or hardware installed not in accordance with SimplyTrak recommendations. i.e. software on a WindowsXP operating system with a broadband or other Internet connection and hardware in accordance with the SimplyTrak fitting instructions issued to all company-commissioned installers as standard.
• 9. You cannot transfer this Limited Warranty to another person or company.

• 2. The warranty is for a swap-out of any unit not performing as originally specified upon the initial agreement.
• 3. The warranty covers both parts and labour for any maintenance required to the units.
• 4. SimplyTrak do not track customers units. The warranty relies upon the customer to inform SimplyTrak of any problems with SimplyTrak hardware or software.

• 9. You cannot transfer this Limited Warranty to another person or company. The warranty is designed to be a fair policy enabling SimplyTrak to offer a fixed price service to our customers for budgetary or other purposes. The price for the warranty is £125 per unit per year and is non-negotiable.

Additional Software Warranty

WARNING: The computer program on the CD Rom supplied with SimplyTrak tracking systems is protected by copyright law and international treaties. Unauthorized reproduction and/or distribution of this program, or any portion of it, may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law.

The product is suitable and intended for general vehicle tracking, travel planning, informational and personal visual reference use only. The product should not be used for any purpose requiring exact measurement of distance or direction, or for precision in address location or in the depiction of geographic locating features. Any routing directions included in the product should be used only as a vehicle locating or travel planning aid and should be verified by the end-user, paying strict attention to traffic and road conditions, road signs and road regulations, which may change periodically.
